Licensing

I've crafted plain-English licenses so that both you and I understand what's going on here. Anyone that wants to use PixelMonkey should also easily understand what these licenses mean!

The various versions of PixelMonkey are distributed as a License; that is, when you download the Trial version or purchase one of the other versions, that click is an acknowledgement (by you) that you agree to the terms of the license.

All versions of PixelMonkey are copyrighted. They're mine. That means, don't take it and try to sell it yourself. You don't have a license to do that. (But see the license agreement for the Trial Version for one exception.) No matter which version you choose, you agree to not reverse-engineer the application. Don't try to change my application. It's provided as-is, and you agree to not monkey with it. If you want a new feature or a bug fix, contact us.

No warranty, express or implied, is provided. If your computer breaks while running this application, you are absolving me of responsibility. I have attempted to ensure that such a thing can't happen, but I can't guarantee it. Windows sometimes does screwy things, but more relevantly: there's no warranty because if I did provide one, I'd open myself up to nuisance suits. I am not a fan of our legal system here in the U.S., or our litigious society. Sorry, no warranty.

Trial License

Distribution of the Trial Version is free. Give it to your friends! If you do give it to anyone else or make it available to anyone else, you agree to have them abide by the remainder of this agreement, including the text up there in the general "Licensing" section.

There is no Undo in the Trial Version, and I'm unlikely to be proactive about bugfixes and feature enhancements to the Trial Version; I don't sell enough copies to justify that work. The Trial Version is there for you to see if the application works for you. If you like it, buy one of the other licenses.

Because the Trial Version is basically a marketing device, I'm willing to let you be fairly open about redistributing it. The only caveat is that you include this license information (contained in the "license.txt" file in the install) if you make the package available to anyone else, and that you include a link back to ImpendingStudios.com prominently in your distribution or on your website.

If you're in the business of selling compilation CDs or DVDs, you can distribute the Trial Version on a CD or DVD as part of a compilation of PC programs, even if you sell that CD or DVD. If you do so, you must provide a link to the main Impending Studios website, include PixelMonkey and ImpendingStudios logos prominently in the distribution (such information, including screen caps, URLs, or other info, consuming at least 20% each of the display area of the package advertising, package materials, and advertising space), include the license.txt file in the distribution, provide us with a copy of the CD or DVD, and contact us within 7 days of your distribution of the CD or DVD. If you don't like the 15% restriction, contact us first and we can work something out. (Basically, contact us. If you just want to shove it out there, then we want a bunch of advertising.)

If you wish to provide the Trial Version as a digital download, contact us and we'll try to work something out.

Hobby License

There is a nominal charge for this version; it is intended to be used by hobbyists and individuals. It's cheap because I'm expecting that you're not making money from using it; that it's one tool that you might use doing work (for money) but that it's not a major tool.

If you work for someone else, and you use PixelMonkey while performing that work, then you must purchase a Commercial License.

The Hobby License is intended to be used by individuals who make tiles as a hobby, or as an occassional side job. This is a real version of the program; the major feature it includes (over the Trial Version) is Undo. One of the reasons I made this program was so that I could touch up tile sets, or pull together a set from a bunch of different images. If that's all you do, the Community Version is the one you want.

You know it's going to be difficult for me to find you, so let your judgement and sense of honor guide you. And make some cool stuff!

Commercial License

This version is available as a seat license.

If you work for someone else, and you use PixelMonkey while performing that work, then you must purchase a Commercial License.
